Plain English summary: TheCommish.app provides software for running sports pools. We are a tool — not a gambling operator. Commissioners are responsible for their own pools, their own money, and compliance with their local laws. By using this platform, you agree to these terms.

1. About TheCommish.app

TheCommish.app ("the Platform," "we," "us," or "our") is a sports pool management software service. The Platform provides tools for commissioners to create and manage sports pools, and for players to participate in those pools.

TheCommish.app is a software platform only. We do not operate, sponsor, or endorse any contest or pool created on the Platform. We do not collect, hold, process, or distribute any entry fees, prize money, or any other funds related to pools or contests.

2. Acceptance of Terms

By creating an account, accessing, or using TheCommish.app, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Platform.

You must be at least 18 years of age to use TheCommish.app. By creating an account, you confirm that you are 18 years of age or older.

3. Account Registration

To use the Platform, you must create an account with a valid email address, name, and phone number. You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Providing accurate and current information
Notifying us immediately of any unauthorized use of your account

We reserve the right to terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used inappropriately.

4. Commissioner Responsibilities

Users who create and manage pools ("Commissioners") accept the following additional responsibilities:

Legal compliance: Commissioners are solely responsible for ensuring their pools comply with all applicable local, state, federal, and international laws, including but not limited to laws governing contests, sweepstakes, and sports pools.
Prize money and entry fees: Commissioners are solely responsible for collecting, holding, and distributing any entry fees and prize money. TheCommish.app has no involvement in any financial transactions between commissioners and players.
Pool rules: Commissioners are responsible for clearly communicating pool rules to their players and for administering their pools fairly and consistently.
Player data: Commissioners may access player contact information (name, email, phone) for the purpose of administering their pool. Commissioners agree not to use player data for any other purpose, including marketing unrelated to the pool.
Jurisdictional restrictions: Commissioners are responsible for understanding whether operating a paid sports pool is legal in their jurisdiction and the jurisdictions of their players. TheCommish.app makes no representation regarding the legality of any pool in any jurisdiction.

5. Player Responsibilities

Users who participate in pools as players ("Players") agree to:

Participate honestly and in good faith
Understand and comply with the rules set by their Commissioner
Confirm that participating in paid sports pools is legal in their jurisdiction before joining any pool with entry fees
Direct any disputes about pool administration, prizes, or fees to their Commissioner — not to TheCommish.app

6. Acceptable Use

You agree not to use TheCommish.app to:

Violate any applicable law or regulation
Impersonate any person or entity
Collect or harvest user data without consent
Transmit spam, unsolicited messages, or malicious code
Interfere with or disrupt the Platform or its servers
Attempt to gain unauthorized access to any part of the Platform
Use the Platform in any way that could harm other users

7. Intellectual Property

TheCommish.app and all content, features, and functionality of the Platform are owned by TheCommish.app and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.

You retain ownership of any content you submit to the Platform (pool names, team names, etc.). By submitting content, you grant us a non-exclusive license to use that content to operate and improve the Platform.

8. Fees and Billing

TheCommish.app offers a free tier for commissioners managing pools with up to 25 entries. Paid plans are available for larger pools and premium features. Pricing is displayed on our pricing page and is subject to change with reasonable notice.

All fees paid to TheCommish.app are for access to the software platform only and are separate from any entry fees or prize money associated with individual pools.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THECOMMISH.APP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THECOMMISH.APP IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY COMMISSIONER OR PLAYER, THE ADMINISTRATION OF ANY POOL, OR THE PAYMENT OR NON-PAYMENT OF ANY PRIZES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THECOMMISH.APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO THECOMMISH.APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TheCommish.app from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your operation of any pool on the Platform.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of the State of Georgia.
